U.S.C. § 1738C. Under the law, also known as DOMA,
no state (or other political subdivision within the United States) needs to treat as a marriage a same-sex relationship considered a marriage in another state.
(DOMA Section 3); the Federal Government defines marriage as a legal union between one man and one woman.
Enacted by the 104th United States Congress.

President Obama, refutes DOMA and he wants to change this law to allow marriages of Gay Americans to be recognized Federally, not the opposite!
Also, Section 3 of this law, was declared unconstitutional by a Federal District Court Judge in July 2010.
This decision was appealed in October 2010 and again, on February 23, 2011.
The President's determination concerning DOMA; not being in accordance with the United States Constitution, won't stop appeals by those who want to enforce the law.
His decision contends that the government will no longer uphold this law, and further disputes that DOMA can be declared constitutional upon appeal.
As a result of this, now members of Congress will have to ask permission from the courts to defend the law, if they want to.
